Terms of service

Version 2026-10-03

Draft for legal review. This placeholder is not the final document and must be replaced before anyone outside the test group signs up.

About these terms

These terms are an agreement between you and Comitivo, Inc., a Florida corporation (“Comitivo”, “we” or “us”) for using the Comitivo website, the iPhone app and everything they offer. By creating an account or using Comitivo you agree to them. Our privacy policy and consumer health data policy explain what we do with your information.

Section 17 limits what we owe you if something goes wrong. Please read it, and Section 16 on warranties.

1. Who can use Comitivo

You must be 18 or older and able to make a binding agreement. That includes answering a plan without an account, where an organizer allows it; these terms apply then too. Comitivo is run from the United States; if you use it from another country, you’re also responsible for following the laws there. You can’t use Comitivo if the law bars you from it or we’ve closed your account before.

Your account is for you alone. Give us accurate details, keep the email, phone and accounts you sign in with secure, and tell us at support@comitivo.com if you think someone else has used your account.

2. What Comitivo is, and isn’t

Comitivo helps groups plan trips and nights out together. It is a planning tool, not a travel agent, seller of travel, tour operator or booking service. We don’t sell travel, take payment for it or hold anyone’s money.

  • Bookings happen on other companies’ sites under their terms. We aren’t part of those bookings and aren’t responsible for their prices, availability, changes or refunds. Some links may earn us a commission; when one can, it says so beside it.
  • Settle-up buttons open Venmo, PayPal or Cash App, or show a Zelle detail to copy. Payments happen in those services under their terms. Comitivo never moves money and isn’t a party to what members owe each other; balances and splits are records your group keeps.
  • The estimated cost per person is a guide worked out from what people entered, not a bill or a quote.

3. Information you rely on

Flight status, gates, check-in reminders, weather warnings, arrival times, exchange rates, place details and maps come from other companies or from what members enter. They can be late, incomplete or wrong. Check anything that matters with the airline, the venue or the official source before you act on it. Comitivo is not an emergency service: sharing your arrival time doesn’t tell anyone you need help. In an emergency, call the local emergency number.

4. Allergies and dietary needs

Comitivo never tells you a restaurant or dish is safe for an allergy or diet. Suggestions are “likely options” based on what people entered and on information from others, which can be out of date or wrong. Always confirm with the staff before you order. Your allergy card helps you explain your needs; it doesn’t guarantee anything about a kitchen. Nothing in Comitivo is medical advice. Group counts include only the people who added their needs.

5. The trip assistant

The trip assistant (“Ask the trip”) is an AI, run for us by Anthropic. Its answers can be wrong, incomplete or out of date, so check them before relying on them, and don’t use it for medical, legal, financial or safety decisions. It can’t change your plan: anything it suggests adding is a draft that a person approves. Don’t try to make it ignore its instructions or produce anything these terms don’t allow. It has daily limits, and we may change or pause it.

6. Plans, organizers and invitations

  • Organizers run a plan: they can remove members, turn invite links off and delete the plan. Deleting a plan deletes its chat, photos, reservations and expenses for everyone.
  • What you add to a plan is shared with its members, as the privacy policy describes. If you leave a plan, what you added stays there for the others, except where the privacy policy says it goes.
  • Invite only people you know and who would expect to hear from you, and don’t invite someone who has asked you not to. When you invite someone by email, we send one email on your behalf. We never text people who haven’t signed up; invites by text go from your own phone.

7. Your content

You keep ownership of what you post: messages, photos, reservations, expenses, ideas and the rest. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, process, adapt (for example resizing photos or removing their location), send and show it to the people you share it with, only to run, protect and improve Comitivo and as our privacy policy describes. The permission ends when your content is deleted, except for copies others already saved, content that stays in a plan as Section 6 says, backups kept for a short time, and anything the law requires us to keep.

You’re responsible for what you post and confirm you have the right to post it. Respect the people in your photos and don’t share someone else’s private details without their permission.

8. Rules

Comitivo has zero tolerance for objectionable content and abusive users. Don’t:

  • post anything unlawful, hateful, harassing, threatening, sexually explicit or violent, or any sexual content involving a minor;
  • share intimate images of anyone without their consent;
  • impersonate anyone, or mislead people about who you are;
  • send spam, or use Comitivo to advertise or sell without our permission;
  • collect other people’s information, or publish someone’s private details;
  • post something you don’t have the rights to;
  • upload malware; scrape, copy or bulk-download Comitivo; get around its limits or security; or probe it for weaknesses without our written permission (if you find a security problem, please tell us at support@comitivo.com);
  • copy, take apart or resell the apps, except where the law allows it.

9. Reports, blocks and enforcement

You can report a message or a person, and block people. We review reports within 24 hours and, when content breaks these rules, remove it and suspend or close the account that posted it. We may also remove content or limit, suspend or close an account to comply with the law or protect people, even without a report. We don’t have to watch what people post, and we aren’t responsible for what other users say or do.

10. Copyright complaints

If you believe something on Comitivo infringes your copyright, email us at support@comitivo.com. Include: your contact details; the work you say is infringed; where the material is on Comitivo, in enough detail for us to find it; a statement that you believe in good faith the use isn’t authorized; a statement that your notice is accurate and that you are, or may act for, the owner; and your name as your signature. We remove material that infringes. If we remove something you posted because of a complaint, you can tell us why you believe it doesn’t infringe, and we’ll consider putting it back. We close the accounts of people who repeatedly infringe.

11. Ideas and feedback

Ideas, feedback and survey answers are welcome. We may use them in any way, without paying you or owing you anything. Published ideas never show who suggested them.

12. Messages from us

We send the emails Comitivo needs to work: sign-in emails, invitations, reminders and notices about your account, the plans you’re in and these terms. If you allow notifications, the iPhone app sends them too. You choose what reaches you in Settings, and every non-essential email has a link to stop it; notices about your account’s security, or changes to these terms, still reach you. Product news comes only if you turn it on. If you sign in with your phone number, we text you sign-in codes, and other texts only if you turn them on; your carrier’s message and data rates may apply, and you can reply STOP to stop texts.

13. Other companies’ services

Comitivo works with services we don’t control, such as Apple, Google and Microsoft sign-in, maps, payment apps and booking sites, and their own terms apply when you use them. Place details from Google in the trip assistant are subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy, which you agree to by using them. Maps on the website are © MapTiler © OpenStreetMap contributors.

14. Our rights

Comitivo™, the Comitivo logo, comitivo.com and comitivo.app are our trademarks; don’t use them without permission. The apps and website belong to us and our licensors. We give you a personal, non-transferable license to use them under these terms, which ends if your account closes. Open-source parts are under their own licenses.

15. Changes and ending

We may change, add or remove features, or stop offering Comitivo, and we’ll give you reasonable notice and a chance to download your data before we close it. We may update these terms; when a change matters, we tell you and ask you to accept the new version the next time you sign in. If you don’t agree, stop using Comitivo and delete your account.

You can delete your account at any time in Settings. We may suspend or close your account if you break these terms, if it puts other people or Comitivo at risk, or if the law requires it. Sections 2 to 4, 7 (for content that stays), 11 and 14 to 21 continue after your account closes.

16. Warranties

Comitivo is provided “as is” and “as available.” To the extent the law allows, we make no promises beyond those in these terms, and disclaim all implied warranties, including that Comitivo is fit for a particular purpose, accurate, always available or free of errors, and that information from other companies, other users or the trip assistant is correct.

17. Limits on our liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost bookings, profits, data or goodwill, arising from Comitivo or these terms, even if we were told they might happen. Our total liability for all claims is limited to the greater of US$100 or what you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not all apply to you. Nothing in these terms limits liability that the law doesn’t allow us to limit.

18. If someone makes a claim

If someone makes a claim against us because of content you posted, how you used Comitivo or your breaking these terms or the law, you’ll cover our reasonable costs and losses from it, to the extent the law allows.

19. Disputes

If you have a problem with Comitivo, email us first: most things can be fixed quickly, and we’ll try for 60 days before either of us goes further. These terms are governed by the laws of the State of Florida and of the United States, without regard to conflict-of-law rules. Disputes go to the state and federal courts in Palm Beach County, Florida, except that either of us may use small claims court where it qualifies. If you live somewhere whose consumer law gives you more rights, those rights still apply.

20. If you use the iPhone app

These terms are between you and us, not Apple. Apple isn’t responsible for the app or its content, and has no duty to maintain or support it. If the app fails to meet a warranty that applies, you may tell Apple, which will refund any price you paid for it; Apple has no other warranty duty. We, not Apple, handle any claim about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims. You confirm you aren’t in a country under a US embargo or on a US list of prohibited parties. Apple’s Licensed Application End User License Agreement also applies where these terms don’t cover something. Apple and its subsidiaries may enforce these terms as third-party beneficiaries.

21. The rest

These terms, with the privacy policy and the consumer health data policy, are the whole agreement between us about Comitivo. If a part can’t be enforced, the rest still applies. If we don’t enforce something straight away, we haven’t given up the right to. You can’t transfer these terms; we may transfer them to a company that takes over Comitivo. We aren’t responsible for delays or failures caused by things outside our reasonable control.
